Informal Negotiations To expedite the resolution and reduce the cost of any dispute, controversy, or claim related to these Legal Terms (each a "Dispute" and collectively, the "Disputes") brought by either you or us (individually, a "Party" and collectively, the "Parties"), the Parties agree to first attempt to resolve any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations shall commence upon written notice from one Party to the other.
Binding Arbitration Any Dispute arising from the relationship between the Parties to these Legal Terms shall be resolved by a single arbitrator, selected in accordance with the Arbitration and Internal Rules of the European Court of Arbitration, part of the European Centre of Arbitration, based in Strasbourg. These rules shall apply as they stand at the time the arbitration request is submitted. The seat of arbitration shall be London, United Kingdom, and the proceedings shall be conducted in English. The substantive law applied shall be that of the United Kingdom.
Restrictions The Parties agree that any arbitration shall be limited to the individual Dispute between the Parties. To the fullest extent permitted by law: (a) no arbitration shall be combined with any other proceeding; (b) no Dispute shall be arbitrated on a class-action basis or using class-action procedures; and (c) no Dispute may be brought in a representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Negotiations and Arbitration The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) any Disputes seeking to enforce or protect the intellectual property rights of a Party; (b) any Dispute related to or arising from allegations of theft, piracy, invasion of privacy, or unauthorised use; and (c) any claim for injunctive relief.
If this provision is found to be illegal or unenforceable, then neither Party shall elect to arbitrate any Dispute falling within the portion of this provision found to be illegal or unenforceable. Such Dispute shall instead be decided by a court of competent jurisdiction as per the jurisdictional provisions listed above, and the Parties agree to submit to the personal jurisdiction of that court.
The Services may contain information that includes typographical errors, inaccuracies, or omissions, such as descriptions, pricing, availability, and other details. We reserve the right to correct any such errors, inaccuracies, or omissions and to modify or update the information on the Services at any time, without prior notice.
